Terms of Service

Effective date: 9 April 2025

These terms of service (“Terms”) govern your use of the 8 Scoop's Colouring Factory mobile application (“the App”), operated by Industrial Insight (“we”, “us”, “our”). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse-engineer or attempt to extract the source code.

Your account

You may need to create an account to access certain features. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account.

Acceptable use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms.
  • Submit content that is illegal, harmful, abusive, defamatory, or otherwise objectionable.
  • Attempt to circumvent any access controls, usage limits, or security measures.
  • Use the App to generate content that infringes on the intellectual property rights of others.
  • Use automated systems (bots, scrapers) to access the App.

We reserve the right to suspend or terminate your account if you violate these Terms.

In-app purchases and subscriptions

The App offers in-app purchases and subscriptions processed through Google Play Billing. By making a purchase, you agree to Google Play’s terms of service for payments.

  • Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date.
  • Cancellation: You can cancel a subscription at any time through the Google Play Store. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until then.
  • Refunds: Refund requests are handled by Google Play in accordance with their refund policies.

User-generated content

You retain ownership of the prompts and images you submit to the App. By submitting content, you grant us a limited licence to process it as necessary to provide the service (e.g. sending it to an AI provider for line-art generation). We do not claim ownership of your content and do not use it for purposes beyond providing the service to you.

AI-generated output

The App uses third-party AI services to generate line-art images. Output quality may vary and is provided on an “as-is” basis. We do not guarantee that AI-generated output will be accurate, complete, or suitable for any particular purpose.

Intellectual property

The App and its original content (excluding user-generated content), features, and functionality are owned by Industrial Insight and are protected by copyright, trademark, and other intellectual property laws.

Disclaimer of warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Industrial Insight shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other appropriate means. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
